Hire Terms & Conditions

1. All material let out on hire remains the property of Reliable Access Pty Ltd.
2. All scaffolding materials on hire shall be the total responsibility of the client whilst on site. Any lost, missing, stolen or damaged scaffolding materials shall be deemed to be still on hire until all materials are returned to Reliable Access Pty Ltd’s yard.
3. Upon return of scaffolding materials to Reliable Access Pty Ltd’s yard, the yard staff shall count the materials and upon request supply a detailed yard return docket. The yard count made by Reliable Access Pty Ltd’s yard staff is deemed to be final.
4. Unless otherwise agreed in writing, lost, missing, damaged or stolen scaffolding equipment on hire to a client shall be replaced (at the client’s expense) with new stock at Reliable Access Pty Ltd’s current replacement prices.
5. Reliable Access Pty Ltd reserves the right to immediately remove any scaffolding materials from the hirer’s site immediately without notice, that has not been paid for as per payment terms stated in the invoice.
6. Reliable Access Pty Ltd will be provided 72 hours notice (3 normal working days) from the client to collect any scaffolding materials from the client’s site for return to Reliable Access Pty Ltd’s yard.
7. Any additional Labour, Transport and Scaffold Hire will be regarded as extra to contract work. Unless otherwise agreed in writing, the additional costs associated with the additional services provided outside the contract will be invoiced.
8. In the case of extra to contract works being carried out, a revised or additional quote will be issued by Reliable Access Pty Ltd for authorisation by the client.
9. All additional labour works requested by the client shall be for a minimum of 4 hours irrespective of time taken to perform the task. After a 4-hour period, a minimum of 8 hours will be charged.
10. The Client is to ensure that adequate facilities for tying the scaffold to the building facade or structure are made available and maintained. Reliable Access Pty Ltd cannot be held responsible for any accident or damage of any sort whatsoever if their materials are shifted, tie systems or any other part of the scaffold structure are altered by the Client or others.
11. The client acknowledges that during the scaffold erection phase, the scaffold is not complete and therefore is not safe to utilise until a Scaffold Tag has been attached stating the structure is complete and safe.
12. Other than where permission has been granted by Reliable Access Pty Ltd in writing, the client acknowledges that only scaffolders employed by Reliable Access Pty Ltd are permitted to either erect, alter or dismantle scaffold owned by Reliable Access Pty Ltd.
13. The client acknowledges that all permits (council or otherwise) and engineered computations are not included in any quotations unless otherwise stated on the contract.
14. The client acknowledges that Reliable Access Pty Ltd will not incur any liquidated damages action throughout the duration of its contract to the client, nor have any monies held over for retention whatsoever.
15. Payment shall be made by the client within 30 days from date of invoice or as otherwise stated on the invoice, unless agreed in writing.
16. Any costs incurred for debt collection and/or legal action for recovery of any overdue amounts will be recoverable as a debt due by the Client.

ACCEPTANCE OF TERMS AND CONDITIONS

These Terms and Conditions form part of the Reliable Access Pty Ltd Hire and Services Contract. Acceptance of these Terms and Conditions is captured through the completion and signing of the Reliable Access Pty Ltd New Account Application Form, in which the authorised representative of the client acknowledges having read and agreed to be bound by these Terms and Conditions in their entirety.

By submitting a completed New Account Application Form, the client agrees that these Terms and Conditions constitute a legally binding agreement between the client and Reliable Access Pty Ltd, and will apply to all current and future scaffolding hire and services provided by Reliable Access Pty Ltd.
